The revelations that US ally Abdelhakim Belhadj is now leading ISIS in Libya should come as no surprise to those who have followed US policy in that country, and throughout the region. It illustrates for the umpteenth time that Washington has provided aid and comfort to precisely those forces it claims to be fighting around the world.

According to recent reports, Abdelhakim Belhadj has now firmly ensconced himself as the organizational commander of the ISIS presence inside Libya. The information comes from an unnamed US intelligence official who has confirmed that Belhadj is supporting and coordinating the efforts of the ISIS training centers in eastern Libya around the city of Derna, an area long known as a hotbed of jihadi militancy.

While it may not seem to be a major story – Al Qaeda terrorist turns ISIS commander – the reality is that since 2011 the US and its NATO allies have held up Belhadj as a “freedom fighter.” They portrayed him as a man who courageously led his fellow freedom-lovers against the “tyrannical despot” Gaddafi whose security forces at one time captured and imprisoned many members of the Libyan Islamic Fighting Group (LIFG), including Belhadj. ****(But Belhaj being an MI5 agent knew how to survive and betrayed all of his comrades to avoid prison he stayed in-house arrest for one year and then was free to go where ever he pleased. He was never tortured by the Libyan Jamahiryia and he was never deprived of anything he demanded. Belhadj’s history of terrorist activity includes such “achievements” as collaboration with Al Qaeda in Afghanistan and Iraq, and of course his convenient servitude to the US-NATO sponsored rampage across Libya that, among other things, caused mass killings of black Libyans and anyone suspected of being part of the Green Resistance (those loyal to the Libyan Arab Jamahiriya led by Gaddafi). Although the corporate media tried to make a martyr of Belhadj for his alleged torture via the CIA rendition program, the inescapable fact is that wherever he goes he leaves a violent and bloody wake.

While much of this information is known, what is of paramount importance is placing this news in a proper political context, one that illustrates clearly the fact that the US has been, and continues to be, the major patron of extremist militants from Libya to Syria and beyond, and that all talk of “moderate rebels” is merely rhetoric designed to fool an unthinking public.

The Enemy of My Enemy is My Friend…Until He Isn’t

There is ample documented evidence of Belhadj’s association with Al Qaeda and his terrorist exploits the world over. Various reports have highlighted his experiences fighting in Afghanistan and elsewhere, and he himself has boasted of killing US troops in Iraq. However, it was in Libya in 2011 where Belhadj became the face of the “rebels” seeking to topple Gaddafi and the legal government of Libya.

As the New York Times reported:

The Libyan Islamic Fighting Group was formed in 1995 with the goal of ousting Colonel Qaddafi. Driven into the mountains or exile by Libyan security forces, the group’s members were among the first to join the fight against Qaddafi security forces… Officially the fighting group does not exist any longer, but the former members are fighting largely under the leadership of Abu Abdullah Sadik [aka Abdelhakim Belhadj].

So, not only was Belhadj a participant in the US-NATO war on Libya, he was one of its most powerful leaders, heading a battle-hardened jihadist faction that constituted the leading edge of the war against Gaddafi. Nowhere was this more clearly demonstrated than when the Libyan Islamic Fighting Group (LIFG) took the lead in the attack on Gaddafi’s compound at Bab al-Aziziya. In this regard, LIFG was provided intelligence, and likely also tactical support, from US intelligence and the US military.

This new information about Belhadj’s association with the suddenly globally relevant ISIS certainly bolsters the argument that this writer, among many others, has made since 2011 – that the US-NATO war on Libya was waged by terrorist groups overtly and tacitly supported by US intelligence and the US military. Moreover, it dovetails with other information that has surfaced in recent years, information that shines a light on how the US exploited for its own geopolitical purposes one of the most active terrorist hotbeds anywhere in the world.

According to the recent reports, Belhadj is directly involved with supporting the ISIS training centers in Derna. Of course Derna should be well known to anyone who has followed Libya since 2011, because that city, along with Tobruk and Benghazi, were the centers of anti-Gaddafi terrorist recruitment in the early days of the “uprising” all through the fateful year of 2011. But Derna was known long before that as a locus of militant extremism.

In a major 2007 study entitled “Al-Qa’ida’s Foreign Fighters in Iraq: A First Look at the Sinjar Records” conducted by the Combating Terrorism Center at the US Military Academy at West Point, the authors noted that:

Almost 19 percent of the fighters in the Sinjar Records came from Libya alone. Furthermore, Libya contributed far more fighters per capita than any other nationality in the Sinjar Records, including Saudi Arabia… The apparent surge in Libyan recruits traveling to Iraq may be linked the Libyan Islamic Fighting Group’s (LIFG) increasingly cooperative relationship with al-Qa’ida which culminated in the LIFG officially joining al-Qa’ida on November 3, 2007…The most common cities that the fighters called home were Darnah [Derna], Libya and Riyadh, Saudi Arabia, with 52 and 51 fighters respectively. Darnah [Derna] with a population just over 80,000 compared to Riyadh’s 4.3 million, has far and away the largest per capita number of fighters in the Sinjar records.

And so, the US military and intelligence community has known for nearly a decade (perhaps longer) that Derna has long been directly or indirectly controlled by jihadis of the LIFG variety, and that that city had acted as a primary recruiting ground for terrorism throughout the region. Naturally, such information is vital if we are to understand the geopolitical and strategic significance of the notion of ISIS training camps associated with the infamous Belhadj on the ground in Derna.

This leads us to three interrelated, and equally important, conclusions. First, Derna is once again going to provide foot soldiers for a terror war to be waged both in Libya, and in the region more broadly, with the obvious target being Syria. Second is the fact that the training sites at Derna will be supported and coordinated by a known US asset. And third, that the US policy of supporting “moderate rebels” is merely a public relations campaign designed to convince average Americans (and those in the West generally) that it is not supporting terrorism, despite all the evidence to the contrary.

The Myth of ‘Moderate Rebels’

The news about Belhadj and ISIS must not be seen in a vacuum. Rather, it should be still further proof that the notion of “moderates” being supported by the US is an insult to the intelligence of political observers and the public at large.

For more than three years now, Washington has trumpeted its stated policy of support to so-called moderate rebels in Syria – a policy which has at various times folded such diverse terror groups as the Al Farooq Brigades (of cannibalism fame) and Hazm (“Determination”) into one large “moderate” tent. Unfortunately for US propagandists and assorted warmongers however, these groups along with many others have since voluntarily or forcibly been incorporated into Jabhat al-Nusra and ISIS/ISIL.

Recently, there have been many reports of mass defections of formerly Free Syrian Army factions to ISIS, bringing along with them their advanced US-supplied weaponry. Couple that with the “poster boys” for Washington policy, the aforementioned Hazm group, now having become part of Jabhat al Nusra, the Al Qaeda linked group in Syria. Of course these are only a few of the many examples of groups that have become affiliated with either the ISIS or Al Qaeda brand in Syria, including Liwaa Al-Farouq, Liwaa Al-Qusayr, and Liwaa Al-Turkomen to name just a few.

What has become clear is that the US and its allies, in their unending quest for regime change in Syria, have been overtly supporting extremist elements that have now coalesced to form a global terror threat in ISIS, Nusra, and Al Qaeda.

But of course, this is nothing new, as the Belhadj episode in Libya demonstrates unequivocally. The man who was once Al Qaeda, then became a “moderate” and “our man in Tripoli,” has now become the leader of the ISIS threat in Libya. So too have “our friends” become our enemies in Syria. None of this should surprise anyone.

But perhaps John McCain would like to answer some questions about his long-standing connections with Belhadj and the “moderates” in Syria. Would Obama like to explain why his “humanitarian intervention” in Libya has become a humanitarian nightmare for that country, and indeed the whole region? Would the CIA, which has been extensively involved in all of these operations, like to come clean about just who they’ve been supporting and what role they’ve played in fomenting this chaos?

I doubt any such questions will ever be asked by anyone in the corporate media. Just as I doubt any answers will ever be furnished by those in Washington whose decisions have created this catastrophe. So, it is for us outside the corporate propaganda matrix to demand answers, and to never let the establishment suppress our voices…or the truth.

CAIRO • The U.S military says it launched weekend airstrikes targeting and likely killing an al-Qaida-linked militant leader in eastern Libya charged with leading the attack on a gas plant in Algeria in 2013 that killed at least 35 hostages.

An Islamist with ties to Libyan militants, however, said the airstrikes missed Mokhtar Belmokhtar.****(We know for a fact that the US MILITARY does not miss…. I am convinced that he was warned by the Rogue CIA/MOSSAD to leave the premisses as its going to be hit. Instead, the missiles killed four members of a Libyan extremist group that the U.S. has linked to the Sept. 11, 2012, attack on the U.S. Consulate in Benghazi. ***(Instead of putting Hillary and her crew in Jail for the MURDER OF CHRIS STEVENS AND THREE SPECIAL FORCES which there is proof about it, the US still goes on with the lie that the Libyan extremist did it…. not that I feel sorry for the extremist being dead but we have to put the facts: Stevens death was an inside job, we know it and so does the US foreign policy know it…. U.S. officials said they are still assessing the results of the Saturday strike, but Pentagon spokesman Col. Steve Warren said the military believes the strike was successful and hit the target. Neither U.S. officials nor the Libyan government provided proof of Belmokhtar’s death, which likely requires a DNA test or an announcement by Belmokhtar’s group that he was killed.

“I can confirm that the target of last night’s counterterrorism strike in Libya was Mokhtar Belmokhtar,” Warren said Sunday.

A U.S. official said two F-15 fighter jets launched multiple 500-pound bombs in the attack. The official was not authorized to discuss the details of the attack publicly so spoke on condition of anonymity. Authorities say no U.S. personnel were on the ground for the assault.

But this isn’t the first time authorities have claimed to have killed Belmokhtar, a militant believed to be 43 who reportedly lost his eye in combat and fought in Afghanistan. He was one of a number of Islamist fighters who have battled Algeria’s government since the 1990s, later joining al-Qaida.

An al-Qaeda letter obtained by The Associated Press suggests Belmoktar pocketed about US$1-million for the release of Canadian diplomat Robert Fowler in Niger four years ago. **** and the United States wants us to believe that he is not under the payroll? We know for a fact that neither America or Canada negotiate with terrorists…. What is wrong with this picture?)

The letter was sent by al-Qaeda’s North African branch to Belmoktar, who split from the group to conduct his own operations, including the Fowler kidnapping in December 2008.

Fowler, the highest-ranking UN official in Niger, and his colleague Louis Guay, were kidnapped and held for four months before being released in April 2009.

The letter said that a plan to force concessions in the U.S.-led war in Afghanistan was stymied when Belmoktar struck his own deal for about $1-million for both men.  ****As it has been proven that Bin Laden was USA proxy man so is Belmoktar… with all the Intel, spooks, special forces, snipers, NSA and other Secret agencies the US wants us to believe that they could not kill this man???????? InterpolInterpol has issued an international arrest warrant for Moktar Belmoktar in connection with the kidnapping of Canadian diplomat Robert Fowler and his colleague Louis Guay in December 2008.

 

Belmokhtar is also known as Belaouer the One Eyed, Abou al-Abbes and Mister Marlboro, the last name a play on the fact he’s accused of smuggling contraband cigarettes through the Sahara and the Sahel.

The U.S. filed terrorism charges in 2013 against Belmokhtar in connection with the Algeria attack. Officials have said they believe he remained a threat to U.S. and Western interests. Belmokhtar had just split off from al-Qaida in the Islamic Maghreb to start his own franchise.

The Libyan government in a statement Sunday said that the strike targeting Belmokhtar came after consultation with the U.S. so that America could take action against a terror leader there.

One government official in Libya said an airstrike in the northeastern coastal city of Ajdabiya hit a group of Islamic militants also believed linked to al-Qaida and that it killed five and wounded more. He said the group that was wounded later fought the Libyan military that guarded the hospital there, leading to a hourslong battle. He spoke on condition of anonymity because he was not authorized to speak to reporters. The official couldn’t confirm that was the same strike that killed Belmokhtar.

The Islamist, who spoke on condition of anonymity for fear of reprisals in restive Libya, told The Associated Press early Monday that Belmokhtar wasn’t at the site of the U.S. airstrike. He said the strike killed four Ansar Shariah members in Ajdabiya, some 850 kilometres east of the Libyan capital, Tripoli.

American officials have linked Ansar Shariah to the Sept. 11, 2012, attack on the U.S. Consulate in Benghazi. ****Who by the way, were under the American embassy payroll to protect the US Consulate in Benghazi together with another brigade called 17 February…. so again I ask what is wrong with this picture????

The charges filed against Belmokhtar by federal law enforcement officials in Manhattan included conspiring to support al-Qaida and use of a weapon of mass destruction. Additional charges of conspiring to take hostages and discharging a firearm in furtherance of a crime of violence carry the death penalty.

At the time, U.S. Attorney Preet Bharara said in a release that Belmokhtar “unleashed a reign of terror years ago, in furtherance of his self-proclaimed goal of waging bloody jihad against the West.”

Authorities also offered a $5 million reward for information leading to the arrest of Belmokhtar. ****So why don’t they ask the GNC in Tripoli to give them the information? Or one of the leaders of Daesh or better yet why don’t the ask Belmokhtar’s buddy Abdulhakim Belhaj he knows were he is hiding actually he has his mobile number on speed dial… oh! yes I forgot they can not involve another notorious Terrorist like Belhaj as he must be installed as the new LEADER OF LIBYA…. and showing such connections would put in jeopardy the UN, USA AND THE EUROPEAN UNION for being in cohorts with a the most wanted and hated man in the planet. This is a very sincere issue, it is very important that we take this announcement very seriously. The latest UN draft states that all armed groups will need to leave the cities, yet Bady here announces that there are plots being set which could refer to the UN Dialogue meaning that he will not hand over Tripoli or pull his forces out no matter what. ****(What to lose all the luxury, power and the thrill of watching the fear in the eyes of the Tripolitanian’s)
Shouldn’t it be necessary that the GNC make a clear statement that they have full control over these militias and show the world where they stand on this new operation? ***(The GNC has no control never had/have the ones who control Tripoli are BELHAJ, BADY and THE UNITED STATES REPRESENTED BY DEBORAH JONES…..)

The prosecuting authorities had information that a cargo ship would try to illegally deliver cargo in the port of Libya which is under the control of armed criminal organization of ISIS in order to use it for their own use to the war that continues to grip the devastated country.

So with combined business since Port Authority and the Hellenic Navy spotted the truck vessel south of Crete. Immediately was organized undertaking of the special forces of the Port Authority men which they undertook storming on board the truck vessel to check the authenticity of the documents that accompanied the cargo.

The audit revealed that the the truck vessel ship had sailed from the UAE was destined for Libya but there were no documents to justify its cargo namely the end-user certificate (End User Certificate) something that automatically made it illegal cargo.

Besides there was absolutely no justification and from an official entity of the UN as well as to extract military equipment to Libya which requires permission of the organization.

From the investigation conducted later in the hold of the ship‘s men Port Authority they found:

Forthwith after verification of the cargo on the vessel that had leased the company Streit Security Systems was seized and the ship is at a port of Crete in order to make the unloading.

As mentioned authorities have reasonable suspicions that the cargo had as the final beneficiary the terrorist organization ISIS branches which operate in Libya and which are equipped with fast pace in order to occupy more and more of the country.

The loss of the consignment is considered a great loss as the MRAP vehicles would be particularly useful for a range of uses from the Islamists.

Now all of this equipment, information about presence of small quantities of portable weapons has been confirmed, it will come into possession of the SCE will acquire quite inexpensive 18 MRAP vehicles which had previously.

Indeed the lack of vehicles meant that the forces ELDAF in Afghanistan were forced to request and receive five vehicles MRAP American V type structure to meet their needs but which then returned.

The Typhoon vehicle is type 4 × 4 category as mentioned armored and protective ambushes, mines and IED (Mine Resistant Ambush Protected) and can carry up to 10 equipped troops.

OPINION: Libya has one government and one parliament

Libya has one government and one parliament.

Nevertheless, members of the international media and foreign policy makers around the world are distorting this simple fact by speaking of Libya’s government as divided. Repetition has created a misleading media narrative and imposed a perceptual reality that in effect divides Libya. It is pressuring the country’s beleaguered democratization process to a point where it may be aborted, or worse, push Libya towards partition.
A Constitutional Declaration was written in August 2011 to guide Libya forward through the transitional period following its Revolution. Nevertheless, this essential document and the plan it lays out to lead a unified Libya to a democratic civil state is overlooked.
It is disturbing to see legitimate institutions, formed within the framework of the Constitutional Declaration, equated with so-called governments and institutions that are the product of violence. How are acts of warstorming the doors of governmental institutions, forcibly occupying ministries, shelling cities with missiles and destroying the country’s largest airport along with hundreds of millions of dollars of planes – be considered comparable to democratic process?
Peaceful transfer of power is a cornerstone in the democratization processes of newborn democratic states. Libya went through three elections, two of which involved a transfer of power. In accordance with the Constitutional Declaration, Libyan voters elected the country’s House of Representatives (HoR) on 25 June 2014; the House of Representatives then appointed an interim government headed by Prime Minister Abdullah Al-Thinni.
How, after the hard-won steps Libya has taken towards democracy, can members of the diplomatic community and media refer to the democratically elected HoR as the “Tobruk parliament” and its legitimate government as the “Al-Thinni government,” thus ignoring the June 2014 election results and distorting the historical record?
Meanwhile, international media and diplomats refer to the remnant group of politicians in Tripoli as the “GNC,” the parliament that preceded the HoR. The General National Congress (GNC) mandate expired on 21 July 2014 when the results of the HOR election were announced. However, one week before, a coalition of Islamist and regional militias launched an armed operation, called Operation Dawn, to take over the capitol Tripoli. After weeks of urban warfare, it succeeded on 23 August. Operation Dawn’s first political move was to call on the GNC to resume sessions and to appoint a government. A small group of former GNC members began to meet and appointed Omar Al-Hassi as Prime Minister of, what he termed, a National Salvation Government.
Needless to say, the imposition of the rump GNC had no footing in the Constitutional Declaration and was in violation of democratic principles. The mandate of the GNC had expired and there is no constitutional provision for its return. In reality, the rump GNC, composed of thirty or fewer of the original 200-member parliament, became the political arm of the Operation Dawn militias.
How is it possible for a country unified under a Constitutional Declaration to have a “Tobruk parliament” and at the same time a rump “GNC”? The intent of this article is to dust off the truth and build a better understanding of Libya’s governing institutions and the plan laid out in the Constitutional Declaration.

Phase 1: The Constitutional Declaration, August 2011
The Constitutional Declaration was issued by the self-proclaimed political entity of the February 2011 Revolution, the National Transitional Council (NTC). It was simple and recognized the self-proclaimed NTC as the highest authority of the state, granting it a mix of legislative and executive powers. It allowed for the NTC to appoint (and dissolve) a cabinet to govern. A timetable stipulated that the NTC hand over power to an elected body, the GNC, within 240 days from the declaration of the liberation of Libya. Elections for the GNC were held on 7 July 2012 and on the 8 August, in a ceremonial event, the NTC publicly announced the transfer of power to the first parliament elected by Libyans in nearly 50 years.
The ceremony took place under the scrutiny of a people who had survived generations under dictatorship. On that remarkable day, at a time when militias were positioned in every corner, in every city, the NTC managed to transfer power to a purely civil entity chosen by the Libyan people. Nevertheless, the transfer ceremony was not without incident. Salah Badi, an elected GNC member who  demanded that a young Libyan woman leave the stage because her head was uncovered. Sarah Messelati, who was only 22, left the room quietly. However, shamefully no one in the gathering, including women representing 16% of elected GNC members, spoke up in her support. That day, everyone’s hearts and eyes were clinging to the power transfer ceremony and eager for it to take place as quickly and quietly as possible.
In addition to establishing the GNC, the Constitutional Declaration also created the Constitutional Drafting Assembly (CDA) tasked with writing the future Libyan constitution. It allowed 60 days for the CDA to draft the Constitution and then forward it to the Libyan people for referendum. This period was later extended to 180 days.

Phase 2: The General National Congress, July 2012-July 2014
In July 2012, the GNC replaced the NTC as the highest authority of Libya. The main goal and task of the GNC during its mandate was to establish the Constitutional Drafting Assembly (CDA). Following ratification of the Constitution, a second transfer of power would occur, with the GNC handing over to the newly-elected institutions prescribed in the Constitution. In summary, this second phase was about drafting a constitution and a subsequent peaceful power transfer, by which the transitional period would end and a new democratic civil state would be launched.
However, the GNC neglected its mandate, interfered with the executive branch and focused on promulgating a political isolation law by which Libyans became unequal before the law. This law was adopted in May 2013 under armed pressure from militias connected with sympathetic members of the GNC.
Finally, after eight months, the GNC realized it had been sharply diverted from its principle mission and appointed a committee to draft the CDA election law. The CDA election took place in February 2014, over a year and a half after the GNC assumed office. The CDA’s first session was held in the town of Baida in April 2014.

Phase 2.5: The February Committee, February-April 2014
As the GNC tenure wore on, it became increasingly apparent that the body was unable to run the country efficiently and its interference with the executive was making governance an impossible mission. When the GNC finally initiated the process of drafting the CDA election law in April 2013, disgruntled Libyans were already in the streets demanding that the GNC step down and transfer power to a new representative body.
Every time the GNC stretched the period of fulfilling its major duty, the establishment of the CDA, it also stretched its own mandate and continued to be the highest authority in the country. It became clear that the simplicity of the Constitutional Declaration did not account for a separation or balance of powers between the executive and legislative branches of government. The conclusion reached by the citizenry and many members of the GNC was that the limitations of the Constitutional Declaration made the GNC inadequate as a vehicle to take Libya out of the transitional period to a modern constitution.
Under tremendous pressure from within the GNC and the general public, a Sixth Amendment to the Constitutional Declaration was adopted by the GNC, by which a new phase was drawn to revive the democratization process. The GNC created a constitutional committee called the February Committee to take the necessary steps to amend the Constitutional Declaration to allow new parliamentary and presidential elections. Accordingly, the GNC decided to end to its existence, even before a constitution was issued and transfer power to a new parliament. This new parliament would be based on democratic principles, including separation of powers between branches, a series of checks and balances and a distinctly separate executive branch headed by an elected president with a clear mandate to state powers. By taking this step, the legislative power would no longer be the highest authority of the state of Libya.
A new road map introduced by the February Committee added an additional phase to allow for a new parliamentary body, the House of Representatives (HoR) and a directly elected President. Most significantly, the February Committee introduced a conventional module of governance based on equilibrium and separation of powers.
On 31 March 2014, the GNC adopted the February Committee’s first set of recommendations. However, the matter of the election of a President of the State was postponed to be reviewed by the HoR. The newly elected HoR would resolve whether the President would be elected directly by the people (as recommended by the February Committee) or by the HoR. By doing so, the GNC again created hurdles to the democratization process. The elements of the February Committee proposal were interconnected and could only be adopted as a whole. Any substantive changes or postponement of the proposal’s clauses rendered the concept of democratization refreshment useless.

Therefore, a third and additional phase, which was not originally anticipated in the Constitutional Declaration, was adopted by the GNC in March. On 29 April , the GNC passed Election Law Number 10 of 2014 to provide for the election of the HoR. This third phase afforded a dignified exit to the GNC and a peaceful hand over to a new parliament. The GNC was under an obligation to fulfill the peaceful transfer of power to the HoR as its predecessor had to it. Any failure to do so entailed individual legal responsibility of GNC members before the law.

Phase 3: The House of Representatives, June 2014-present
The GNC adopted a series of required legislative steps to insure a peaceful transfer of power to the HoR. These included a decree issued by the GNC President ordering preparations for the ceremonial transfer of power to the HoR and calling on the HoR to convene.

Beginning in May 2014 armed conflict ignited in parts of Libya and till now, this continues to complicate Libya’s transition to democracy. At the time of the 25 June election, fighting was underway in the city of Benghazi. An thinkable tragedy unfolded the night of the election when Salwa Boughaigis, a prominent civil society activist, lawyer, and deputy president of the National Preparatory Dialogue Commission, was brutally murdered in her home in Benghazi, not long after she posted on social media photos of herself voting. Her husband, Essam Gheriani, was kidnapped and to date has not been found. A national hero for her role in the revolution, Boughaigis became one of hundreds of Libyan civil society activists, military and security professionals, politicians and media figures assassinated in the years following the revolution.
On 21 July 2014, the High National Elections Commission announced the results of the H0R election: 188 members out of 200 were elected. The remaining twelve would have been from communities that were prevented from voting by extremist militias. In addition Amazigh communities chose to boycott the election as part of their campaign against what they claimed was constitutional marginalization.

In line with the February Committee recommendations, the seat of the HoR would be located in Benghazi. Preparations were already in progress to refurbish the Tibesti Hotel as its headquarters in order to allow the HoR to begin meeting there by the end of July. However, the combination of armed conflict, the closure of the airport in Benghazi and other violent incidents made it infeasible for the HoR to convene in Benghazi. The freshly-elected body was forced to quickly find a new place to meet. Given that armed conflict had spread to Tripoli, HoR members followed the suggestion of the body’s senior members and convened in the quiet eastern city of Tobruk on 4 August.
By the time the HoR convened, Libya’s democratization process was in deep crisis, but still surviving. Urban warfare in Tripoli compelled many residents to flee the city, including government ministers who began meeting in the relatively calm and secured city of Beida where the Constitutional Drafting Assembly had been working. This phase of the transitional period can certainly not be described as peaceful. How could it be in a country in the grip of militias?
The inaugural meeting of the HoR was attended by 158 of the 188 elected members; thirty members boycotted in protest of the change of location and some remnant GNC members tried to halt the process under pretext of ceremonial procedure.

Despite the series of decrees the GNC had issued to initiate the necessary steps to ensure a peaceful transfer of power, members of the body, led by its President, Nouri Busahmain, refused to attend the meeting in Tobruk. However, the inaugural session was attended by the GNC’s First Deputy, Ezzedine al-Awami. Al-Awami represented a large bloc of GNC members who supported the democratization and legitimacy requirements defined by the Constitutional Declaration. This document, as amended by the February Committee, emphasizes that the HoR must convene within two weeks of the date of the HNEC announcement of the final election results. This precise date, 21 July 2014, constituted the transfer of power between the GNC and its successor. The Constitutional Declaration stipulates that power and legitimacy originate from the people as “the source of powers.” Therefore, all other related acts and decisions from the previous legislative power are considered ceremonial only and add nothing to the result of the elections.

Immediately after the GNC was announced to be back on stage by the Operation Dawn militias, the media began to use different terms when writing about Libya. The international press went from celebrating the HoR elections, covering the HNEC’s announcement of the winners and speculating on the leadership and political composition of the new parliament, to writing as if Libya had two parliaments and two governments, in effect rendering Libya’s short but rich democratization process insignificant.

The democratization process and its values, including the transfer of power, do not depend on protocol and ceremonies. Ceremonial procedures are never considered an impediment during the democratization process; the crucial and substantive principle of the transfer of power overrides ceremonial procedures. Peaceful transfer of power constitutes a vital obligation for democracy, while the ceremonial process of “hand over,” if any, is merely a public declaration of it. Ceremonial steps cannot be used to impede or block the democratization process. The rump GNC, however, reached a point where it denied any transfer of power, for the simple reason that the GNC President’s insistence to hold the handover ceremony in Tripoli was not accepted by the HoR. To accept the rump GNC’s position would be to say that one person, i.e. “the Speaker of the Parliament,” can twist the whole concept of democracy, and block it.

In addition to the pressures exerted on Libya’s democratization process, foreign policy makers and the international media are undermining the process by imposing an unlawful, illegitimate and artificial reality. Each of the many references to members of the former GNC as the “GNC,” as if the dissolved body continued to exist, constitutes a false and erroneous statement. There is no longer the GNC body; rather, there are some former members of the former GNC who are contravening the spirit of the Constitutional Declaration and the essence of democracy. The GNC wittingly ended its term in office, amending the Constitutional Declaration and issuing legislation and decrees. It can never reverse this process because it is a legal obligation and the GNC is obliged to fulfill this obligation.

The remnant GNC members are claiming that they are still in power based on their interpretation of the Libyan Supreme Court November 6, 2014 ruling. They argue that it dissolves the HoR. Regardless of whether or not this is a correct interpretation, dissolving the HoR does not allow the GNC to return as the governing authority in Libya. If the HoR were dissolved, it would only open venues for new elections, a new road map and a new phase in Libya’s difficult road towards democracy based on the Constitutional Declaration, a political agreement or on a new constitution.

Today there is neither a GNC, nor a so-called National Salvation Government. Legitimacy is not a carte blanche conferred by the media or policy makers. Power can be divided and shared, but legitimacy cannot. If democracy is not only about elections, it is certainly about the transfer of power. If elections alone do not consign legitimacy, then refusal to transfer power is the suffocation and poisoning of democracy itself. The conclusion is that Libya has one government and one parliament.

To think or write about the Libyan State in any other way, gives a false image of Libya and threatens the country’s troubled democratization process, recklessly pushing it towards possible partition.
